Dear Counsel:
The monk Thich Tri Lang and his assistant, nun Thich Nu Kien Tam have published letters under the name of the “Congress” containing derogatory remarks and attacks on my personal life and including my departed mother who passed away in 1994. The publication was done by means of mail and internet. The nun created a new website, to wit daotrangphoquang.net to reach a broad audiencẹ The attacks were also aimed at other board members, to wit Hoa Vo and Chuc Phan. The publication contained false, fabricated or untrue information about current events and also occurrences that occurred more than 10 years ago. The purpose of the publication is to attack the board members’ integrity, and to discredit their role as founders of this church.
Pho Quang Pagoda is a business name/ tradename and was adopted by my Association since 1997. The nun used letter head in the name of the Congress dba Pho Quang Pagoda in all publication. The publication contained the return address of the Association. This is a blatant infringement on the Association’s proprietary name and license. The Congress may alledgedly owned the physical building but it may not own nor persue the tradename and license of the Association which is a separate and independent legal entity registered in the state of Utah.
As you are to meet the opposing counsel representing the Congress and the monk this Wednesday 7/21, I request that you mention the Association’s objection to the publication and considering it as defamation with reckless disregard to the truth. I demand a retraction within 10 days and I intent to file a defamation/libel lawsuit against the Congress, the monk and the nun, et al. if I do not receive an apology within a reasonable time. I herewith attach copy of the publication in Vietnamese for your information. A full translation will be forthcoming.
In the mean time, I authorized the construction team to resume the construction of the pagoda gate at the Church site despite objection from the Congress. Only a court order can stop this motion.
My Association is now working on a fund raising event to be held on August 7 on the school yard of the Rose Park Elementary School which is adjacent to the church property. I do not expect any interference on the part of the Congress, the monk or the nun to sabotage this event. Please notify opposing counsel of the same.
